The Lead-Safe Housing Program is responsible for implementing state regulations aimed at eliminating exposures to lead-based paint often found in older rental properties, and preventing negative health consequence before they occur.
Rental properties in New Jersey constructed prior to 1978 are now subject to legal requirements mandating inspections for lead paint hazards. The New Jersey Lead-Safe Certification Law, New Jersey P.L. 2021, Chapter 182, became effective July 22, 2022.
Property owners must arrange for an initial inspection and certification of each rental unit prior to July 22, 2024, or at the time of tenant turnover, whichever is sooner. Inspections can be arranged by contacting a certified lead evaluation contractor.
Properties located in West Windsor Township require a visual Inspection as the minimally acceptable assessment method. If an inspection reveals conditions which must be remediated, a follow-up inspection and dust wipes samples are required after corrective work is completed.
Periodic inspections are required every two years. Rental properties can be exempted from recurring inspections if a lead-free certificate if obtained rather than a lead-safe certificate. A certified lead evaluation contractor can perform the inspection needed to qualify a home for receipt of a lead-free certificate. This evaluation requires an alternate method of investigation. Property owners should consult with the certified lead evaluation contractor regarding the alternate approaches and fees.
Property owners can choose to directly hire a private certified lead evaluation contractor, or opt to use the Township-facilitated service. Fees apply for both pathways.
